Federal Court Orders Release of Kilmar Abrego Garcia from Immigration Custody

A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks lawful basis.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case originates in a erroneous deportation to El Salvador earlier this year, which the government later admitted was an error. After his return to the United States to answer human smuggling charges, he was detained in immigration detention.

In her order, the court pointed out that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The legal challenge involve disputed claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing criminal case in Tennessee.
